The Department of Justice has dismissed a lawsuit filed by the administration Biden against the State of Idaho on its total abortion prohibition, raiding the way for the prohibition to return to force, according to judicial records.
However, in a separate case, the St. John Hospital system in Idaho was able to obtain a preliminary judicial order that blocks the prohibition of entering into force, according to judicial documents.
The federal case, presented by virtue of the previous administration, but was now withdrawn by the Trump administration, said that the prohibition of abortion of Idaho violated the emergency medical treatment and the Active Labor Law, or Emtala, a federal law that requires that all hospitals that receive Medicare funds provide “stabilization care” to all patients whose health is in danger, according to law.

The total prohibition of abortion from Idaho entered into force in August 2022, prohibiting almost all abortions with exceptions for reported cases of rape or incest or when necessary to prevent the death of pregnant women. “

The rights groups in favor of abortion criticized the decision to dismiss the case, saying that it endangers the lives of pregnant women.

Planned Parenthood also criticized the measure.
